RecruiteAI – Candidate Privacy Notice & Consent
Agreement
This Candidate Privacy Notice and Consent Agreement (“Notice”) explains how RecruiteAI, a service owned and operated by Bitsoft International, Inc. (“Bitsoft”, “RecruiteAI”, “we”, “us”), processes personal data in connection with video-based interviews conducted through the RecruiteAI platform.
1. Roles Under Data Protection Laws
For candidate interview data, the hiring organization that invited you to interview is the Data Controller, as it determines the purpose and means of processing your personal data. RecruiteAI acts as a Data Processor on behalf of the hiring organization. For limited operational data (such as
platform security, fraud prevention, and service analytics), Bitsoft may act as an independent Data Controller.
2. Categories of Personal Data Processed
We may process the following categories of personal data: identity and contact information; video and audio recordings; transcripts of responses; interview metadata; technical and device data; and derived analytical data generated through AI-assisted analysis tools.
3. Biometric and AI-Related Processing
Video and audio recordings may be analyzed using automated tools to generate insights related to communication patterns, speech characteristics, and behavioral indicators. Where applicable,
such processing may involve biometric identifiers or biometric information as defined under certain laws (including Illinois BIPA). These analyses are used solely to assist human review and do not result in fully automated hiring decisions.
4. Legal Bases for Processing
Processing is based on your explicit consent, the performance of recruitment-related services requested by the hiring organization, and compliance with legal obligations. Where required by law, interviews cannot proceed without your consent to recording and analysis.
5. Data Retention
Interview data is retained for the duration determined by the hiring organization, typically between 6 and 12 months, unless a shorter or longer period is required by law. Biometric data, where applicable, is permanently deleted once the initial purpose of collection has been satisfied or upon
earlier request, subject to legal obligations.
6. Data Subject Rights
Depending on your jurisdiction, you may have rights including access, correction, deletion, restriction, objection, portability, and the right to withdraw consent. Requests may be submitted to privacy@recruiteai.com.
7. International Data Transfers
Your data may be transferred to and processed in countries outside your place of residence, including the United States. Where required, such transfers are protected using Standard Contractual Clauses or other lawful transfer mechanisms.
8. Security Measures
RecruiteAI implements appropriate technical and organizational safeguards, including encryption, access controls, audit logs, and secure infrastructure, to protect personal data against unauthorized access, disclosure, or misuse.
9. Sub-Processors
We engage vetted sub-processors such as cloud hosting providers, video storage services, AI service providers, and email delivery platforms. A current list of sub-processors is available upon request.
10. Consent Acknowledgement
By proceeding with the interview, you explicitly consent to the collection, recording, storage, and processing of your personal data, including video, audio, and AI-assisted analysis, for recruitment-related purposes. You acknowledge that you are at least 18 years of age and legally able to provide this consent.
